Syrian Legal expert: Separating Judicial Inspection Department from Ministry of Justice is unconstitutional
DAMASCUS, Syria (North Press) – A legal expert said, on Sunday, that the separation of the Judicial Inspection Department from the administrative structure of the Ministry of Justice is an acknowledgment of the executive authority’s invasion of the judiciary, in violation of the constitution, which states that the judiciary is an independent authority.
A few days ago, an administrative reform conference was held under the auspices of the Ministry of Administrative Development, and came out with a set of recommendations, including: Separating the Judicial Inspection Department from the administrative structure of the Ministry of Justice in order to achieve the principle of separating the executive from the judiciary.
Aref al-Sha’al, a legal expert, residing in Damascus, stated in a post on his Facebook page that this recommendation is not without a pleasant fantasy, since separating the Judicial Inspection Department from the Minister of Justice means joining it to the Supreme Judicial Council, which is originally dominated by the Minister of Justice, “which means removing Minister through the door and enter him again through the window.”
He stressed that the independence of the judiciary and its separation from the executive authority begins with removing the position of the Minister of Justice from the Supreme Judicial Council and making its presidency for the head of the Court of Cassation, as was the case before 1966.
Al-Sha’al was surprised to put this recommendation in this conference, because its place is a conference for constitutional reform, not administrative, as it is not the job of one of the ministries of the executive authority to interfere or specify the tasks of another authority.
