QAMISHLI, Syria (North Press) \u2013 The administration of U.S. President Donald Trump filed on Thursday an emergency request with the U.S. Supreme Court, seeking to overturn a lower court’s ruling that temporarily blocks its efforts to end deportation protections for approximately six thousand Syrians residing in the United States.<\/p>\n\n\n\n
The U.S. Department of Justice submitted a memorandum urging the high court to vacate a decision issued by Judge Catherine Vaila in November. The judge’s order prevented the administration from terminating Syria\u2019s designation for Temporary Protected Status (TPS) pending the outcome of a lawsuit challenging the government’s decision. A New York appeals court upheld Judge Vaila’s ruling on February 17, refusing to stay her order.<\/p>\n\n\n\n
The legal battle stems from a September announcement by U.S. Secretary of Homeland Security Kristi Noem, who moved to end Syria’s TPS designation. In her decision, Noem argued that conditions in Syria “no longer meet the criteria for ongoing armed conflict posing a serious threat to the safety of Syrian nationals upon return.”<\/p>\n\n\n\n
Thursday’s emergency request asserts that Judge Vaila overstepped her authority by blocking the administration’s decision to end the protections afforded to Syrians.<\/p>\n\n\n\n
This marks the third time the Trump administration has turned to the Supreme Court to challenge injunctions against its efforts to terminate TPS for various nationalities. The court has previously sided with the administration in two cases concerning the cancellation of protections for hundreds of thousands of Venezuelans.<\/p>\n\n\n\n
The Department of Homeland Security has moved to end Temporary Protected Status for migrants from a dozen countries. However, similar lawsuits have resulted in court orders currently preventing the implementation of these terminations for nationals of several countries, including Syria, Ethiopia, South Sudan, Haiti, and Myanmar.<\/p>\n\n\n\n
The U.S. administration maintains that the TPS program has been subject to “abuse,” asserting that a number of its beneficiaries “no longer deserve this protection.”<\/p>\n\n\n\n
Temporary Protected Status is a humanitarian designation under U.S. law for nationals of countries experiencing ongoing armed conflict, natural disasters, or other extraordinary conditions. It provides protection from deportation and grants work authorization within the United States.<\/p>\n\n\n\n
The TPS program was first designated for Syrians in 2012 under the administration of former President Barack Obama, following the outbreak of the conflict in Syria.<\/p>\n\n\n\n
